{"id":397,"date":"2023-07-17T16:26:58","date_gmt":"2023-07-17T16:26:58","guid":{"rendered":"https:\/\/progressmo.com\/?p=397"},"modified":"2023-07-17T16:26:58","modified_gmt":"2023-07-17T16:26:58","slug":"missouri-lawyers-andrew-bailey-resign","status":"publish","type":"post","link":"https:\/\/gallant-mclaren.18-188-198-158.plesk.page\/index.php\/2023\/07\/17\/missouri-lawyers-andrew-bailey-resign\/","title":{"rendered":"Missouri Lawyers: Andrew Bailey Should Follow The Law Or Step Down"},"content":{"rendered":"\n<p>On Tuesday, the Missouri Supreme Court will hear arguments in the Attorney General&#8217;s case concerning his illegal power grab for the initiative petition process.<\/p>\n\n\n\n<p>Ahead of the hearing, more than 20 Missouri lawyers have signed the open letter below, calling on Attorney General Andrew Bailey to follow the law or step down:<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Open Letter: When the state\u2019s top legal officer can\u2019t follow the law<\/h2>\n\n\n\n<p>We the undersigned members of the Missouri legal community are writing to express our shock and deep dismay that our state\u2019s highest legal officer has repeatedly shown a willingness to distort and obfuscate Missouri law.<\/p>\n\n\n\n<p>Most recently, Attorney General Andrew Bailey blocked the advancement of initiative petitions based on cost estimates he personally disputed from Auditor Scott Fitzpatrick, resulting in \u201ca failure to perform [his] ministerial duty,\u201d Circuit Judge Jon Beetem wrote.<\/p>\n\n\n\n<p>Beetem ordered the attorney general to certify the fiscal note within the 24 hours, which he brazenly ignored. As the judge wrote in his 20-page opinion on the matter, Bailey \u201chas no authority to substitute his own judgment for that of the Auditor regarding the estimated cost of a proposed measure,\u201d Beetem wrote in his ruling. Bailey\u2019s actions put Fitzpatrick in an \u201cuntenable and absurd position,\u201d the judge said.<\/p>\n\n\n\n<p>In addition, Bailey attempted to take advantage of a consumer protection loophole to impose a rule severely limiting health care for transgender youth \u2013 suspended by an injunction from the courts and later withdrawn.<\/p>\n\n\n\n<p>In her ruling issuing a temporary restraining order blocking the rule, Circuit Court Judge Ellen Ribaudo expressed concerns with Bailey\u2019s bending of Missouri law to unilaterally block health care access to minors. \u201cThis is a novel use of the attorney general\u2019s power to promulgate emergency rules under the Missouri Merchandising Practices Act that has never previously been subjected to judicial scrutiny and may impermissibly invade a function reserved to the legislature,\u201d she wrote.<\/p>\n\n\n\n<p>Both of these actions give us grave concerns about Bailey\u2019s fitness to hold office as he has shown disregard for the courts and the rule of law.
